Acceptable Use & Anti-Spam Policy

1. Introduction

1.1 Purpose

This Acceptable Use & Anti-Spam Policy (“AUP”) is incorporated by reference into the Leadpush Terms of Service and applies to all customers, accounts, and users of Leadpush’s marketing automation, email delivery, and related services (the “Services”).

1.2 Enforcement

Violations of this AUP may result in suspension, termination, and/or legal action, and may occur without prior notice if necessary to protect the integrity, security, or reputation of Leadpush or its customers.

2. Consent & Opt-In Requirements

2.1 Permission-Based Sending

You may only send email communications to recipients who have provided explicit, provable consent to receive such messages from you.

2.2 Prohibited Acquisition of Contacts

The use of purchased, rented, scraped, or harvested email addresses is strictly prohibited.

2.3 Recency of Consent

You may not send marketing messages to recipients who have been inactive for more than twenty-four (24) months without obtaining fresh consent.

3. Prohibited Content and Activities

3.1 Content Restrictions

You may not send, transmit, or promote content that:

1. is adult, pornographic, or sexually explicit;
2. relates to gambling, betting, or casinos;
3. is political campaigning or lobbying;
4. constitutes hate speech, harassment, or abusive material;
5. contains fraudulent, deceptive, or misleading claims; or
6. offers illegal products or services.

3.2 Technical Misuse

You may not:

1. send messages with falsified headers or deceptive subject lines;
2. attempt to circumvent sending limits or warm-up schedules;
3. interfere with or disrupt the performance of the Services.

4. Sending Practices & Reputation Standards

4.1 Warm-Up Policies

New accounts are subject to sending limits and gradual increase in volume (“warm-up”) to protect deliverability.

4.2 Trust Score Monitoring

Leadpush continuously monitors bounce rates, spam complaints, engagement metrics, and abuse reports to determine account health.

4.3 Bounce Rate Requirements

You must maintain a daily bounce rate below 2%. If your bounce rate reaches 5% or higher in a single day, your account may be reviewed and sending may be paused.

4.4 Complaint Rate Requirements

You must maintain a spam complaint rate of 0.1% or better (1 complaint per 1,000 messages). If your complaint rate reaches 0.5% or higher, your account will be reviewed and may be paused.

4.5 Enforcement Actions

If thresholds are exceeded, Leadpush may:

1. reduce sending limits;
2. require list hygiene or verification measures; or
3. suspend sending privileges until remediation is complete.

5. Technical Requirements for Marketing Emails

5.1 Identification and Transparency

All marketing emails must include:

1. a valid “From” name and email address;
2. a functional unsubscribe link that works for at least thirty (30) days after sending; and
3. your valid physical mailing address.

5.2 Compliance with Laws

You must comply with all applicable laws, including:

1. CAN-SPAM Act (United States);
2. Canada’s Anti-Spam Legislation (CASL); and
3. GDPR ePrivacy Directive (if sending to EU recipients).

6. Monitoring and Enforcement

6.1 Content Review

Leadpush reserves the right to scan, review, and monitor content transmitted through the Services to enforce this AUP.

6.2 Immediate Suspension

Leadpush may immediately suspend or terminate an account if sending practices threaten our infrastructure or reputation.

6.3 External Reporting

We may report egregious violations to ISPs, ESPs, blocklist operators, or legal authorities as appropriate.

7. Reporting Abuse

7.1 How to Report

If you believe a Leadpush user is violating this policy, please send an email to abuse@leadpush.io with:

1. the full message headers;
2. the message content; and
3. the date and time the message was received.
