This Acceptable Use & Anti-Spam Policy (“AUP”) is incorporated by reference into the Leadpush Terms of Service and applies to all customers, accounts, and users of Leadpush’s marketing automation, email delivery, and related services (the “Services”).
Violations of this AUP may result in suspension, termination, and/or legal action, and may occur without prior notice if necessary to protect the integrity, security, or reputation of Leadpush or its customers.
You may only send email communications to recipients who have provided explicit, provable consent to receive such messages from you.
The use of purchased, rented, scraped, or harvested email addresses is strictly prohibited.
You may not send marketing messages to recipients who have been inactive for more than twenty-four (24) months without obtaining fresh consent.
You may not send, transmit, or promote content that:
You may not:
New accounts are subject to sending limits and gradual increase in volume (“warm-up”) to protect deliverability.
Leadpush periodically evaluates hard-bounce rates, spam complaint rates, engagement metrics, and abuse reports to determine account health. Hard-bounce and complaint rates are measured over a rolling twenty-four (24) hour window, rather than by calendar day.
Leadpush evaluates these rates both across your Account and for each Workspace associated with your Account. Sender-reputation states and enforcement actions apply at the Account level. As a result, activity in any Workspace may affect your entire Account, and an Account suspension applies to all associated Workspaces.
For purposes of this policy:
Thresholds are applied to the unrounded rate only after the following minimum sending volumes are reached within the rolling window:
Activity below these minimum volumes may still be monitored for abuse, but the automated rate thresholds in Sections 4.4 and 4.5 will not be applied solely on the basis of that rate.
Your Account may be placed in an At Risk state when either of the following occurs:
When an Account is At Risk, Leadpush may provide a warning, reduce sending limits, require list hygiene or address-verification measures, require evidence of recipient consent, or take other reasonable steps to prevent further reputation damage.
Your Account may be automatically suspended without prior notice when either of the following occurs:
These thresholds are subject to the minimum sending volumes in Section 4.3. A suspension is Account-wide and blocks email sending through all Workspaces associated with the Account.
A suspended Account will remain suspended unless and until Leadpush manually reinstates it. Reinstatement is not automatic or guaranteed.
To request reinstatement, the Account owner must contact Leadpush support, identify and correct the underlying list-quality, consent, or sending-practice issue, and provide any remediation information reasonably requested by Leadpush. Before an Account may be reinstated, its current rolling twenty-four (24) hour metrics must no longer meet either automatic suspension threshold. Leadpush may reinstate an Account to either a Healthy or At Risk state, impose additional sending restrictions, deny reinstatement, or terminate the Account in cases of serious or repeated violations.
The thresholds above do not limit Leadpush’s right to take immediate action in response to suspected spam, fraud, unlawful activity, threats to the Services or their reputation, repeated violations, or other breaches of this AUP.
All marketing emails must include:
You must comply with all applicable laws, including:
Leadpush reserves the right to scan, review, and monitor content transmitted through the Services to enforce this AUP.
Leadpush may immediately suspend or terminate an Account if sending practices threaten our infrastructure or reputation, whether or not the minimum volumes or rate thresholds in Section 4 have been reached.
We may report egregious violations to ISPs, ESPs, blocklist operators, or legal authorities as appropriate.
